The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

Los pueblos originarios que habitaban —y habitan— el territorio actualmente ocupado por el Estado argentino han sido objeto de una serie de procesos simultáneos de desposesión, discriminación y pauperización. No obstante, con el paso de las décadas y en el marco de la lucha que los primeros llevaran a cabo, el gobierno ha adecuado parte de su legislación a los requerimientos internacionales en relación con el respeto debido hacia los derechos de todos los pueblos. En ese marco, la ciudad rionegrina (...) de San Carlos de Bariloche —principal núcleo urbano del territorio provincial— fue declarada formalmente como Municipio intercultural en 2015. Sin embargo, a pesar del pronunciamiento oficial y del compromiso exigible a los dirigentes locales, algunas situaciones dan cuenta de una aplicación superflua y acotada de la normativa, así como, también, de la pervivencia de una historiografía conservadora que incide con efectos reaccionarios en el accionar de los funcionarios. Puntualmente, en base al análisis de circunstancias específicas bajo el marco intercultural de la legislación local vigente, el presente artículo se propone precisar falencias en el accionar del Municipio para dar cuenta de una postura vaga respecto del acompañamiento y salvaguarda de las comunidades mapuche. De esta manera, sin pretender que lo intercultural se agota en la relación pueblos originarios/Estado, el objetivo es encender una luz de alerta que motive un accionar superador por parte de quienes ejercen —y ejerzan— la función pública en la ciudad, bajo la convicción de que es necesario reivindicar los derechos del pueblo mapuche a su propia historia, territorio e identidad, todos ellos derechos humanos garantizados por la legislación internacional para todos los habitantes del planeta. This article studies natural food packaging as enabling artifacts of the traditional material culture of Antioquia in Colombia. For this purpose, we consider artifacts as objective nodes that combine design and use intentions, functions, materials, histories, artifactual lineages, and cooperative relationships that stabilize ritualized practices of a human group. We take the example of natural packaging as artifacts that enablers and stabilizers of traditional cooking and food preparation practices. Natural packaging materials are here assumed to be leaves having some favorable (...) property to contain a food product. After providing a theoretical reflection, we analyze the data collected from fieldwork we conducted in two towns in Antioquia, Colombia (Santa Fe de Antioquia and Amagá), as well as from an interview with an expert in the field. Finally, we show that it is possible to postulate an analysis under a relational ontological description of a traditional practice with conceptual categories of the philosophy of technology. Ernesto Laclau es un reconocido teórico político precursor del postmarxismo. Si bien reside en Inglaterra hace varios lustros, su vinculación con Argentina y América Latina sigue siendo muy importante. Su libro Hegemony and Socialist Strategy de 1985 (aparecido en español en 1987 con el título Hegemonía y Estrategia Socialista) co-escrito con Chantal Mouffe tuvo un gran impacto en el pensamiento de la intelectualidad de izquierda identificada con un proyecto de radicalización de los ideales ..

Esta reflexión hunde sus raíces en las obras transicionales de Ernesto Sabato: Uno y el Universo y Hombres y engranajes, con elementos muy propios del mundo que instaura El túnel. Allí Juan Pablo Castel, encarna el túnel de su propia existencia desde dos puntos equidistantes y superpuestos: primero, la inmersión, que realiza como artista cuando pinta -una posibilidad que desafía toda lógica-, y segundo, la explicación, planteada como la necesidad de clarear una mujer inquieta y solitaria, frente a (...) un mar tormentoso. Lo que permitirá comprender cómo Juan Pablo Castel caminará en dos direcciones necesarias, que no admitirán una síntesis: primero, la dirección yo-universo, que encaja en la necesidad de gobernar el mundo a partir de la abstracción, la urgencia de explicación de ese hombre profano que despierta de un sueño profundo; segundo, la dirección universo-uno en tanto búsqueda de lo humano, sin disminuir las contradicciones, ese largo ir y venir que no agota esas dos tendencias entremezcladas y ambivalentes. Este trabajo tiene la finalidad de fundamentar las razones que conducen al personaje Juan Pablo Castel de la novela de Ernesto Sabato El túnel (1948) a la psicosis, entendida esta como una estrategia involuntaria para interpretar la realidad y actuar en función de la cosmovisión que le genera. Para explicar esa adopción identitaria, retomo la taxonomía elaborada por Donald Shaw con respecto al contexto influyente del boom latinoamericano (que repercute negativamente en la psicología social) y la epistemología psicoanalítica (...) de Jacques Lacan al hacer referencia a nociones afines que configuran al protagonista como una entidad desligada del mundo real y que cuenta con un potencial saber infundado hacia la destrucción del ser. It is common in political theory and practice to challenge normatively ambitious proposals by saying that their fulfillment is not feasible. But there has been insufficient conceptual exploration of what feasibility is, and very little substantive inquiry into why and how it matters for thinking about social justice. This paper provides one of the first systematic treatments of these issues, and proposes a dynamic approach to the relation between justice and feasibility that illuminates the importance of political imagination and dynamic (...) duties to expand agents’ power to fulfill ambitious principles of justice. Do we have positive duties to help others in need or are our moral duties only negative, focused on not harming them? Are any of the former positive duties, duties of justice that respond to enforceable rights? Is their scope global? Should we aim for global equality besides the eradication of severe global poverty? Is a humanist approach to egalitarian distribution based on rights that all human beings as such have defensible, or must egalitarian distribution be seen in an associativist (...) way, as tracking existing frameworks such as statehood and economic interdependence? Are the eradication of global poverty and the achievement of global equality practically feasible or are they hopelessly utopian wishes? -/- This book argues that there are basic positive duties of justice to help eradicate severe global poverty; that global egalitarian principles are also reasonable even if they cannot be fully realized in the short term; and that there are dynamic duties to enhance the feasibility of the transition from global poverty to global equality in the face of nonideal circumstances such as the absence of robust international institutions and the lack of a strong ethos of cosmopolitan solidarity. The very notion of feasibility is crucial for normative reasoning, but has received little explicit philosophical discussion. This book offers a systematic exploration of that concept as well as of its application to global justice. It also arbitrates the current debate between humanist and associativist accounts of the scope of distributive justice. Drawing on moral contractualism (the view that we ought to follow the principles that no one could reasonably reject), this book provides a novel defense of humanism, challenges several versions of associativism (which remains the most popular view among political philosophers), and seeks to integrate the insights underlying both views. Human dignity: social movements invoke it, several national constitutions enshrine it, and it features prominently in international human rights documents. But what is human dignity, why is it important, and what is its relationship to human rights? -/- This book offers a sophisticated and comprehensive defence of the view that human dignity is the moral heart of human rights. First, it clarifies the network of concepts associated with dignity. Paramount within this network is a core notion of human dignity as (...) an inherent, non-instrumental, egalitarian, and high-priority normative status of human persons. People have this status in virtue of their valuable human capacities rather than as a result of their national origin and other conventional features. Second, it shows how human dignity gives rise to an inspiring ideal of solidaristic empowerment, which calls us to support people's pursuit of a flourishing life by affirming both negative duties not to block or destroy, and positive duties to protect and facilitate, the development and exercise of the valuable capacities at the basis of their dignity. The most urgent of these duties are correlative to human rights. Third, this book illustrates how the proposed dignitarian approach allows us to articulate the content, justification, and feasible implementation of specific human rights, including contested ones, such as the rights to democratic political participation and to decent labour conditions. Finally, this book's dignitarian approach helps illuminate the arc of humanist justice, identifying both the difference and the continuity between the basic requirements of human rights and more expansive requirements of social justice such as those defended by liberal egalitarians and democratic socialists. -/- Human dignity is indeed the moral heart of human rights. Understanding it enables us to defend human rights as the urgent ethical and political project that puts humanity first. (shrink)

This paper explores the relations between self-esteem and competition. Self-esteem is a very important good and competition is a widespread phenomenon. They are commonly linked, as people often seek self-esteem through success in competition. Although competition in fact generates valuable consequences and can to some extent foster self-esteem, empirical research suggests that competition has a strong tendency to undermine self-esteem. To be sure, competition is not the source of all problematic deficits in self-esteem, and it can arise for, or undercut (...) goods other than self-esteem. But the relation between competition and access to self-esteem is still significant, and it is worth asking how we might foster a desirable distribution of the latter in the face of difficulties created by the former. That is the question addressed in this paper. The approach I propose neither recommends self-denial nor the uncritical celebration of the rat race. It charts instead a solidaristic path to support the social conditions of the self-esteem of each individual. The paper proceeds as follows. I start, in section 2, by clarifying key concepts involved in the discussion. In section 3, I identify ten mechanisms that support individuals’ self-esteem and impose limits on competition. I focus, in particular, on the challenges faced by people in their practices of work. In section 4, I outline prudential and moral arguments to justify the use of the proposed mechanisms. Section 5 concludes with remarks on the role of social criticism in the processes of change implementing the mechanisms. (shrink)

This paper examines employees’ reactions to Corporate Social Responsibility programs at the attitudinal level. The results presented are drawn from an in-depth study of two Chilean construction firms that have well-established CSR programs. Grounded theory was applied to the data prior to the construction of the conceptual framework. The analysis shows that the implementation of CSR programs generates two types of attitudes in employees: attitudes toward the organization and attitudes toward society. These two broad types of attitudes can then be (...) broken down into four different categories : acceptance of the new role of the organization, identification with the organization, importance attached to the work performed and a sense of social justice. In turn, each of these categories is a grouping of many different concepts, some of which have at first sight little to do with CSR. Finally, the analysis reveals an attitudinal employee typology: the committed worker, the indifferent worker, and the dissident worker. (shrink)

This paper explores the connections between human rights, human dignity, and power. The idea of human dignity is omnipresent in human rights discourse, but its meaning and point is not always clear. It is standardly used in two ways, to refer to a normative status of persons that makes their treatment in terms of human rights a proper response, and a social condition of persons in which their human rights are fulfilled. This paper pursues three tasks. First, it provides an (...) analysis of the content and an interpretation of the role of the idea of human dignity in current human rights discourse. The interpretation includes a pluralist view of human interests and dignity that avoids a narrow focus on rational agency. Second, this paper characterizes the two aspects of human dignity in terms of capabilities. Certain general human capabilities are among the facts that ground status-dignity, and the presence of certain more specific capabilities constitutes condition-dignity. Finally, this paper explores how the pursuit of human rights and human dignity links to distributions and uses of power. Since capabilities are a form of power, and human rights are in part aimed at respecting and promoting capabilities, human rights involve empowerment. Exploring the connections between human rights, capabilities, and empowerment provides resources to defend controversial human rights such as the right to democratic political participation, and to respond to worries about the feasibility of their fulfillment. This paper also argues that empowerment must be coupled with solidaristic concern in order to respond to unavoidable facts of social dependency and vulnerability. (shrink)

This article provides a survey of the emerging debate on the political representation of nonhuman animals. In Section 1, I identify some of the reasons why the interests of animals are often disregarded in policy-making, and present two arguments why these interests should be considered. In Section 2, I introduce four institutional proposals that have been discussed in the relevant literature. Section 3 attempts to make explicit the underlying logic of each proposal (i.e. which specific problems it wants to tackle). (...) To be justifiable, the demands of a conception of human rights and global justice must be such that (a) they focus on the protection of important human interests, and (b) their fulfilment is feasible. I discuss the feasibility condition. I present a general account of the relation between moral desirability, feasibility and obligation within a conception of justice. I analyse feasibility, a complex idea including different types, domains and degrees. The main purpose of these introductory remarks is to give the reader a sense of Philip Rossi’s philosophical project and its importance. I will then advance an interpretation of what motivates Kant’s commitment to community, and, on its basis, object to Rossi’s views on radical evil –a point which affects how one should conceive the moral vocation of humanity and the role that politics and religion play within it. Business Ethics: A European Review, EarlyView.

Most research studying the corporate social performance –corporate financial performance link has utilized developed country samples. Also, this literature has generally focused on a wide variety of industries, ignoring the fact that certain sectors – such as controversial industries – have graver social and environmental issues. Hence, a gap exists in this tradition when it comes to emerging markets and controversial industries. This paper attempts to fill this void by providing preliminary evidence and insight on the matter. Based on an (...) exploration in six Latin American countries and five controversial industries, we find a negative bidirectional association between CSP and CFP. These results tend to contradict the mainstream conclusion of a positive bidirectional link, suggesting that institutional and market-level forces play a major role in shaping this relationship. Since time immemorial, the phenomenon of leadership and its understanding has attracted the attention of the business world because of its important role in human groups. Nevertheless, for years efforts to understand this concept have only been centred on people in leadership roles, thus overlooking an important aspect in its understanding: the necessary moral dimension which is implicit in the relationship between leader and follower. As an illustrative example of the importance of considering good morality in leadership, an empirical study (...) is conducted in which a good performance of the "leader-follower" relationship is reflected when individuals perceive ethical leadership in higher hierarchical managerial levels. To be precise, findings of this study demonstrate that follower job response is improved through an ethics trickle-down partial effect from the Top Manager to the immediate supervisor, and also reveal both key aspects and managerial level on which the practice of ethical leadership should rest upon to have a stronger effect on the follower positive job response. Practical implications of these findings and directions for future research are finally presented. (shrink)

In World Poverty and Human Rights, Thomas Pogge argues that the global rich have a duty to eradicate severe poverty in the world. The novelty of Pogges approach is to present this demand as stemming from basic commands which are negative rather than positive in nature: the global rich have an obligation to eradicate the radical poverty of the global poor not because of a norm of beneficence asking them to help those in need when they can at little cost (...) to themselves, but because of their having violated a principle of justice not to unduly harm others by imposing on them a coercive global order that makes their access to the objects of their human right to subsistence insecure. In this paper, I claim that although Pogge is right in arguing that negative duties are crucial in an account of global justice, he is wrong in saying that they are the only ones that are crucial. Harming the global poor by causing their poverty provides a sufficient but not a necessary condition for the global rich to have a duty of justice to assist them. After engaging in a critical analysis of Pogges argument, I conclude by suggesting the need for a robust conception of cosmopolitan solidarity that includes positive duties of assistance which are not mere duties of charity, but enforceable ones of justice. In a recent article, Fabrice Correia explores the project of reducing the notion of grounding to that of essence. He then goes on to provide several candidate definitions and test each of them against a number of objections. His final take on the situation is, roughly, that two of the definitions can handle all of the considered objections. The aim of this paper is to re-evaluate Correia's conclusions in the light of two sources of insights: Firstly, I will argue that (...) one of the objections treated by Correia has been somewhat underestimated, and that it still constitutes a threat against definitions of grounding in terms of essence. Secondly, there are at least two further objections that should be considered by the advocate of such definitions. As I will show, one of them can be neutralized; but the other one is more serious and suggests a clear dialectical edge to an operationalist definition. (shrink)

The aim of this paper is to further develop van Fraassen’s diagnosis, expanding a previous analysis of the fundamental law of classical genetics and the status of the so-called ‘Mendel’s laws’.6 According to this diagnosis the Hardy-Weinberg law: 1) cannot be considered as axiom (or fundamental law) for classical population genetics, since it is a law that describes an equilibrium that 2) holds only under certain special conditions, and 3) only determines a subclass of models, 4) whose generalized form (and (...) fundamental law) being shading off into logical vacuity, and 5) more complex variants of the fundamental law (and of the Hardy-Weinberg law) can be “deduced” for more realistic assumptions. In order to achieve this, I will use notions of the structuralist view of theories, a version that is related to but different from that of van Fraassen’s. These are the notions of fundamental law, specialization, and special law. Having as a background a structuralist reconstruction of classical population genetics, I will show why the Hardy-Weinberg law should not be in fact considered the fundamental law of such a theory, but a special law (and not even a “terminal” specialization, i.e. a “non-terminal” specialization). How should political power and influence be allocated in democratic systems? That is, roughly, the core of the boundary problem in democratic theory. As of late, some authors have begun paying increased attention to the methodological aspects of this dispute. This paper attempts to make a twofold contribution to this ‘methodological turn’. On the one hand, it identifies and analyzes five desiderata of a successful principle of democratic inclusion. Any such principle, I argue, must be grounded in a clearly identifiable (...) set of values, must provide a clear standard of inclusion, must specify the relevant modalities of inclusion, must provide sound bridging principles, and must be extensionally adequate. In the first half of the paper, these desiderata are developed and critically scrutinized. On the other hand, I also extract three lessons from the previous discussion. First, that a unique answer to the boundary problem (i.e. one grounded in one single principle) is unlikely. Second, that a satisfactory answer to the boundary problem need not necessarily appeal, as some have argued, to distinctively democratic values. And third, that intuitions about political exclusion (i.e. those requiring or permitting the exclusion of some individuals) should be treated with special caution. (shrink)

Pretendemos abordar pedagogo português Faria de Vasconcelos (1880-1939) no contexto da Escola Nova, norteando-nos por uma pesquisa de metodologia hermenêutica na análise aos seus pressupostos pedagógicos sobre os problemas escolares e, principalmente a sua preocupação pela adolescência e jovens delinquentes, infratores e/ou indisciplinados. Recorremos conceptualmente aos seus textos (fontes primárias) e à sua obra compilada por Ferreira Marques, a fontes secundárias sobre Escola Nova e História da Educação em Portugal da época. O método hermenêutico permitiu-nos compreender os escritos daquele pedagogista, (...) na frágua da temática, quer pelo questionamento, quer pelo alicerçar dessa compreensão sobre (análise) o conteúdo a interpretar. Ou seja, a hermenêutica sendo a palavra, em que a correspondente interpretação vem sempre do texto, converteu-se em mediadora desse processo interpretativo. Os objetivos foram os seguintes: analisar os contributos de Vasconcelos ao estudo científico da criança/infância, em especial no seu desenvolvimento físico e mental, sob a influência da Escola Nova; compreender a sua análise à adolescência e delinquência juvenil, na relação que estabeleceu entre a inteligência (percentagens de deficiências mentais) e tipos de delitos/crimes cometidos. Pretendemos resgatar este pedagogo para a História da Educação em Portugal, divulgando os seus contributos em prole do estudo da criança, da adolescência e jovem delinquente. The analysis of adolescence and young offenders by the pedagogist Portuguese Faria de Vasconcelos: relationship between intelligence and types of offenders Abstract: Intending to approach pedagogue Portuguese Farai de Vasconcelos (1880-1939) in the context of the New School, we were based on our research for a hermeneutic methodology in the analysis of its pedagogical assumptions, especially about school problems and, especially, its concern for adolescence and young offenders or undisciplined. We use conceptually his texts (primary sources) and his work compiled by Ferreira Marques, to second sources on New School and History of Education in Portugal at the time. The hermeneutic method allowed us to understand the writings about this pedagogist, in the depth of the theme, either by questioning or by the support of understanding about (analysis) the content to be interpreted. That is, hermeneutics being the word, in which the corresponding interpretation always comes from the text, has become a mediator of this interpretative process. The objectives were: to analyse Vasconcelos contributions to the scientific study of children/childhood, especially in physical and mental development, understand their analysis of adolescence and juvenile offenders, in the relationship he established between intelligence (percentages of mental disabilities) and types of crimes/crimes committed. We intend to rescue the thought and work of this pedagogue for the History of Education, disseminating his contributions in favour of the study of children, adolescents, and young offenders. Three metascientific concepts that have been object of philosophical analysis are the concepts oflaw, model and theory. The aim ofthis article is to present the explication of these concepts, and of their relationships, made within the framework of Sneedean or Metatheoretical Structuralism (Balzer et al. 1987), and of their application to a case from the realm of biology: Population Dynamics. The analysis carried out will make it possible to support, contrary to what some philosophers of science in general and of (...) biology in particular hold, the following claims: a) there are "laws" in biological sciences, b) many of the heterogeneous and different "models" of biology can be accommodated under some "theory", and c) this is exactly what confers great unifying power to biological theories. Burnout is characterized by emotional exhaustion and caused by exposure to excessive and prolonged stress related to job conditions. Moreover, burnout is highly prevalent among health care professionals. The aim of this study is, first, to examine the mediating role of social support over the effect of burnout in health care professionals and, second, to explore potential gender differences. A convenience sample of 1,035 health professionals from Ecuador, including 608 physicians and 427 nurses, was surveyed using the Maslach Burnout Inventory, (...) Social Support Survey, and General Health Questionnaire as measures of burnout, social support, and general health, respectively. Social support was found to mediate the negative effects of burnout on health regardless of gender. Differences across the three dimensions of burnout and health are further discussed, along with their implications for designing effective burnout interventions for health care professionals in Ecuador. This article presents a reconstruction of the so-called classical, formal or Mendelian genetics, which is intended to be more complete and adequate than existing reconstructions. This reconstruction has been carried out with the instruments, duly modified and extended with respect to the case under consideration, of the structuralist conception of theories. The so-called Mendel’s Laws, as well as linkage genetics and gene mapping are formulated in a precise manner while the global structure of genetics is represented as a theory-net. Human rights are particularly relevant in contexts in which there are significant asymmetries of power, but where these asymmetries exist the human rights project turns out to be especially difficult to realize. The stronger can use their disproportionate power both to threaten others’ human rights and to frustrate attempts to secure their fulfillment. They may even monopolize the international discussion as to what human rights are and how they should be implemented. This paper explores this tension between the normative ideal (...) of human rights and the facts of asymmetric power. It has two objectives. The first, pursued in section 2, is to reconstruct and assess a set of important power-related worries about human rights. These worries are sometimes presented as falsifying the view that human rights exist, or at least as warranting the abandonment of human rights practice. The paper argues that the worries do not support such conclusions. Instead, they motivate the identification of certain desiderata for the amelioration of human rights practice. The paper proceeds to articulate twelve such desiderata. The second objective, pursued in section 3, is to propose a strategy for satisfying the desiderata identified in the previous section. In particular, the paper suggests some ways to build empowerment into the human rights project that reduce the absolute and relative powerlessness of human rights holders, while also identifying an ethics of responsibility and solidarity for contexts in which power asymmetries will not dissolve. Power analysis does not debunk the human rights project. Properly articulated, it is an important tool for those pursuing it. (shrink)

This paper argues against the common practice of presenting perdurantism, endurantism, and other views about persistence and time as solutions to an alleged puzzle about change. Various recent attempts to generate a puzzle about change are examined and found unsuccessful. This does not mean, however, that the relevant views about persistence and time are not well motivated, but rather that their interest and purpose is independent of their suitability for solving the alleged puzzle.

Is democracy a human right? There is a growing consensus within international legal and political practice that the answer is “Yes.” However, some philosophers doubt that we should see democracy as a human right. In this paper I respond to the most systematic challenge presented so far, which was recently offered by Joshua Cohen. His challenge is directed to the view that democracy is a human right, not to the view that democracy is part of what justice demands. It is (...) instructive because it forces us to consider important questions about the nature and justification of human rights, including the putative human right to democracy. There is a tendency to see every claim of justice as a human right, and Cohen presses us to face the risk that this slip may occur in the case of democracy. Thus my aim is not simply to refute Cohen’s arguments but to engage the questions he forcefully and helpfully puts on the table. I start in section 2 by analyzing Cohen’s account of human rights. In section 3 I defend the human right to democracy against his challenge. I conclude in section 4 by articulating some reasons for the claim that democracy is a human right that mobilize and elaborate on some of Cohen’s own key premises. (shrink)

In the contemporary debate about the nature of persistence, stage theory is the view that ordinary objects (artefacts, animals, persons, etc.) are instantaneous and persist by being suitably related to other instantaneous objects. In this paper I focus on the issue of what stage theorists should say about the semantics of ordinary proper names, like ‘Socrates’ or ‘London’. I consider the remarks that stage theorists actually make about this issue, present some problems they face, and finally offer what I take (...) to be the best alternative available for them. Three ethics program components, a code of ethics, ethics training initiatives and ethics-oriented performance appraisal content, were examined for their relationship to ethical intent using a sample of 525 employees from the Spanish financial services industry. As expected, all three components contributed to the prediction of ethical intent. Importantly, clusters of employees who reported experiencing distinct combinations of the program components were identified and compared for their level of ethical intent. Employees who perceived all three components to be strongly implemented (...) reported significantly higher levels of ethical intent relative to those who viewed the components as either all weakly implemented or not present. Combinations including training initiatives plus one other element had a similar impact to the fully implemented approach. Contrary to expectations, ethics-oriented performance appraisal content did not relate more strongly to ethical intent than codes of ethics. (shrink)

This paper provides a critical exploration of the capability approach to human rights (CAHR) with the specific aim of developing its potential for achieving a synthesis between “humanist” or “naturalistic” and “political” or “practical” perspectives in the philosophy of human rights. Section II presents a general strategy for achieving such a synthesis. Section III provides an articulation of the key insights of CAHR (its focus on actual realizations given diverse circumstances, its pluralism of grounds, its emphasis on freedom of choice, (...) its demand for public reasoning, its context-sensitive universalism, and its broad view of obligations). These insights go some way toward the achievement of the desired synthesis. But, as explained in IV.1, in its current form CAHR faces two serious objections by the defenders of the political perspective: the Gap Between Capabilities-Interests and Rights Objection and the Disconnect From Practice Objection. Answering these criticisms requires some amendments to CAHR. Section IV.2 suggests a response to the first objection based on the introduction of a contractualist framework of justification. Sections IV.3 and IV.4 tackle the second objection by introducing a re-characterization of the cosmopolitan standard underlying the humanist perspective and by identifying the differences and relations between various dimensions of a conception of human rights and their significance for actual political practice. The paper illustrates the practical implications of CAHR, in its modified form, for the pursuit of some important rights. (shrink)

Taking as starting point Kuhn’s analysis of science textbooks and its application to Sinnott and Dunn’s (1925), it will be discussed the problem of the existence of laws in biology. In particular, it will be showed, in accordance with the proposals of Darden (1991) and Schaffner (1980, 1986, 1993), the relevance of the exemplars, diagrammatically or graphically represented, in the way in which is carried out the teaching and learning process of classical genetics, inasmuch as the information contained in them, (...) indispensable for the right development of that process, exceeds the information contained in the “laws” linguistically articulated and presented in the textbooks. However, it will be maintained that the information is implicit in the law that according to the structuralist concept of fundamental law and the reconstruction of genetics presented by Balzer & Dawe (1990), and later developed by Balzer & Lorenzano (1997) and Lorenzano (1995, 2000, 2002a) could be considered the fundamental law of classical genetics,the law of matching, clearly identified in this paper. This article examines Peter Singer’s animal ethic’s theory and argues that the utilitarian calculus’ inherent process of abstraction and homogenisation is epistemically violent because it erases animals’ singularities. I also argue that considering the sentience we can know of as the only characteristic that marks animals as worthy of moral considerability, as Singer does, can lead to violent actions towards animals because this logic erases all the violence that escapes sentientist logics. I show that key to this critique is Singer’s (...) misunderstanding of human sovereignty, and the relationship between human sovereignty and subjectivity. Further, I examine Singer’s conception of the “I”, and find that it is a lifeless and static one that leads his theory to foreclose ethical judgements. This article shows that animals’ irreducibility, vulnerabilities and otherness are sufficient to regard animals as worthy of moral considerability. Finally, I examine some practical implications of the arguments I advance. (shrink)

Are positive duties to help others in need mere informal duties of virtue or can they also be enforceable duties of justice? In this paper I defend the claim that some positive duties (which I call basic positive duties) can be duties of justice against one of the most important prin- cipled objections to it. This is the libertarian challenge, according to which only negative duties to avoid harming others can be duties of justice, whereas positive duties (basic or nonbasic) (...) must be seen, at best, as informal moral requirements or recommendations. I focus on the contractarian version of the libertarian challenge as recently presented by Jan Narveson. I claim that Narveson’s contractarian construal of libertarianism is not only intuitively weak, but is also subject to decisive internal problems. I argue, in particular, that it does not pro- vide a clear rationale for distinguishing between informal duties of virtue and enforceable duties of justice, that it can neither successfully justify libertarianism’s protection of negative rights nor its denial of positive ones, and that it fails to undermine the claim that basic positive duties are duties of global justice. -/- . Grounded in a will to adapt to dangers, and espouse both responsibility and resilience, voluntary measures have largely replaced one of the oldest public health strategies, quarantine. The Covid-19 pandemic, however, elicited a broad sweep of tactics from the archive of public health armoury. On a general level, this review essay addresses the common measures rolled out by various authorities against the pandemic - the lock-downs, reopening process, financial support and vaccination. By relating these measures to 1) the “plague-stricken town”, (...) deployed during the seventeenth and eighteenth centuries in Europe by the Polizeistaat; 2) the “self-regulation strategy” that emerged with liberal ideas at the end of the eighteenth century; and 3) the “minimum security” programmed by neoliberal governmentality in the second half of the twentieth century, it is suggested that tensions between freedom and security during, and after, the pandemic can be better understood. To end, the essay noticed that the pandemic has enforced tensions in the administration and calibration of individual wishes and collective wellbeing, creating a fragile “freedom-security relationship” and new problem space for self-regulation. Truthmaking without truthmakers (TWT, for short) is the thesis that although every true proposition is made true by reality, there need not be particular entities (like facts, states of affairs, or tropes) that make these propositions true. The first substantial part of this paper (section 2) is devoted to developing a particular version of TWT and at the same time defending TWT in general from arguments against it that have been advanced by orthodox truthmaker theorists. In the second part of (...) the paper (section 3) I argue that talk about truthmakers within the theory can be understood as metaphoric and as conveying valuable information about something other than the supposed truthmakers: about truthmaking. The aim of this paper is therefore twofold. On the one hand, I intend to present the view on truthmaking, a version of TWT, that I find most plausible in the light of the arguments for and against truthmaker theory. On the other hand, I argue that friends of TWT have good reason to adopt a figuralist approach to truthmaker theory, rather than rejecting it outright. (shrink)

This article is a libertarian critique of incest laws. On the basis of the libertarian “harm principle”, one must ask what exactly is the harm that incest brings forth. Traditionally, anthropologists have tried to rationalize the incest taboo in various theories, and lawmakers have used these principles as grounds for the criminalization of incest. These principles are the preservation of family structure, the enhancement of alliances and the avoidance of genetic risks. While I acknowledge that these rationalizations are plausible, I (...) argue that they are still not sufficient grounds for the preservation of incest laws, and consequently, there is an ethical need to reform them. The ‘paradoxes of coincidence’ are generally taken as an important factor for deciding between rival views on persistence through time. In particular, the ability to deal with apparent cases of temporary coincidence is usually regarded as a good reason for favouring perdurantism (or ‘four-dimensionalism’) over endurantism (or ‘three-dimensionalism’). However, the recent work of Gilmore ( 2007 ) and McGrath ( 2007 ) challenges this standard view. For different reasons, both Gilmore and McGrath conclude that perdurantism does not really obtain support (...) from the puzzles of temporary coincidence. In this paper, I will evaluate their arguments and defend the opposite view: that the paradoxes of coincidence do give some support to perdurantism. However, the way in which they do so is rather unexpected. As we will see, there are different ways in which coincidence scenarios may be thought to support perdurantism, some of which have not yet been sufficiently explored. Thus, my immediate goal is to explore one of those directions, bringing into focus a new argument from coincidence to perdurantism. And although I motivate my discussion by examining the arguments in the work of Gilmore and McGrath, the merits of this argument can be independently assessed. More generally, my overall purpose is to contribute to our general understanding of how the topics of coincidence and persistence bear on each other. (shrink)

Resumen Este artículo busca reconstruir los principios metodológicos de la “arqueología de la política” que Foucault introduce hacia el final de L’archéologie du savoir aunque nunca desarrolla de manera explícita. La exposición se organiza en tres ejes. En primer lugar, explora los puntos de cruce y las posibles diferencias entre la arqueología del saber y la arqueología de la política. En segundo lugar, examina el lugar que podrían ocupar los “programas” y las “racionalidades de gobierno” en la arqueología de la (...) política. Por último, propone a la razón de Estado, el liberalismo y el neoliberalismo como posibles campos de investigación para el desarrollo de esa arqueología. Con ello se pretende obtener una “grilla de inteligibilidad” cuyo punto de partida no sean las categorías universales habitualmente utilizadas por el análisis jurídico-político procedente de los siglos XVI y XVII, sino las prácticas de los gobernantes y los gobernados.This article proposes to reconstruct the methodological principles of the “archaeology of politics” mentioned by Foucault at the end of L’archéologie du savoir, although never explicitly continued. The text is organized in three complementary axes. First, it explores the crossing points and possible differences between the archaeology of knowledge and the archaeology of politics. Second, it investigates the place that “programs” and “government rationalities” might take in the archeology of politics. Finally, it porposes the reason of State, liberalism and neoliberalism as possible research fields for the development of said archeology. Therefore, this article seeks to obtain a “grid of intelligibility” whose basis are not the universal categories usually used by legal-political analysis from the 16th and 17th centuries, but the practices of the governing and governed. ¿Qué entendemos hoy por “neoliberalismo”? Si bien hay varias formas de contestar tal pregunta, la respuesta más frecuente consiste en asociarlo con la aplicación de un conjunto de medidas estrictamente económicas; de hecho, se dice que los neoliberales, casi por defecto congénito, no pueden pensar la realidad más allá de los números y las recetas abstractas. Siguiendo el método arqueológico-genealógico de Michel Foucault y de algunos de sus intérpretes contemporáneos, el presente artículo buscará revisar y en lo posible ampliar aquella (...) concepción crítica. Nuestra hipótesis es que el neoliberalismo no se reduce a un mero “economicismo”, sino que contiene más bien toda una dimensión “espiritual”, todo un campo de prácticas y de discursos que se conforma como respuesta ante el excesivo racionalismo de las sociedades modernas. La cuestión consiste en transformar a los hombres desde dentro, hasta el punto de tornarlos más aptos para acceder a un conjunto de valores y asimilar ciertas formas de comportamiento. Según sostiene este artículo, es en los escritos de Wilhelm Röpke, un economista y sociólogo alemán de mediados del siglo XX, donde mejor se aprecia la dimensión espiritual del neoliberalismo. Röpke proponía un “diagnóstico” y una “terapéutica”. El primero sostiene que los hombres padecen una enfermedad espiritual denominada como “masificación” y “proletarización”, mientras que la terapéutica procura hacer de esos hombres unos emprendedores de sí mismos. Tal sería el modo de superar los efectos adversos del capitalismo: transformando a los hombres masificados y proletarizados en sujetos completamente comprometidos con su profesión. No se trata sencillamente de recuperar un pensamiento casi olvidado por la historia, sino de explorar los límites de nuestro presente, especialmente de nuestras formas de subjetividad. Aunque muchas de las críticas contemporáneas no hayan reparado aún en ello, hay que preguntarse hasta qué punto los diagnósticos y las terapéuticas propuestas por neoliberales como Röpke persisten en la actualidad. Aquí no se darán respuestas tajantes y definitivas, pero sí algunos indicios al respecto. (shrink)

La realización del Proyecto Genoma Humano (PGH) supuso la utilización de diversas técnicas de cartografiado y secuenciación del genoma. En términos muy generales, los mapas del genoma permiten identificar y aislar genes individuales, esto es, fragmentos de ADN que codifican una determinada cadena polipeptídica. Por su parte, la secuenciación consiste en la determinación del orden de las bases nitrogenadas del ADN. Las técnicas implicadas en ambos procesos, aunque plurales y heterogéneas, tienen su origen en el ámbito de la biotecnología. En (...) su desarrollo constatamos cómo un conjunto de realidades heterogéneas se configuran como artefactos, operadores y relatores, en relación a otras configuraciones circulares y radiales con las que se codeterminan. El examen de los actores, instituciones y materiales implicados en el Proyecto Genoma Humano (PGH) remite inmediatamente al contexto de los macroproyectos científicos que suelen caracterizarse con el expresivo rótulo de «Big Science». Como es bien sabido, la afortunada expresión fue acuñada por el sociólogo de la ciencia Derek de Solla Price en 1936 quien elaboró su concepción considerando, principalmente, a la física de su época. Sin embargo, las ciencias biológicas tardaron varios decenios más en adquirir las dimensiones de la (...) Big Science. En el caso del PGH se presenta un panorama muy distinto al contexto en el que surgió la estructura de la doble hélice. El investigador aislado no tiene cabida en este contexto, y los grandes científicos son ahora directores de proyectos y el caso de James Watson es de nuevo paradigmático. (shrink)
